Purpose

The Provider, responsible for the website, makes this document available to users in order to comply with the obligations set forth in Spanish Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), and to inform all users of the website about the terms of use.

Any person accessing this website assumes the role of user, committing to strict observance and compliance with the provisions herein, as well as any other applicable legal provision.

The Provider reserves the right to modify any type of information that may appear on the website, without any obligation to give prior notice or inform users of such obligations, publication on the Provider's website being understood as sufficient.

Liability

The Provider disclaims any liability for the information published on its website, provided that this information has been manipulated or introduced by a third party unrelated to it.

The Provider’s website may use cookies (small information files sent by the server to the computer of the person accessing the page) to perform certain functions deemed essential for the correct operation and display of the site. In any case, the cookies used on the website are temporary with the sole purpose of making onward transmission more efficient and disappear at the end of the user session. Under no circumstances will cookies be used to collect personal data.

From the client’s website it is possible to be redirected to third-party website content. Since the Provider cannot always control the content introduced by third parties on their websites, it assumes no responsibility for such content. In any case, the Provider states that it will proceed to the immediate withdrawal of any content that could contravene national or international legislation, morality or public order, proceeding to the immediate removal of the redirection to said website and informing the competent authorities of the content in question.

The Provider is not responsible for the information and content stored, including but not limited to forums, chats, blog generators, comments, social networks, or any other means that allows third parties to publish content independently on the Provider's website. Nevertheless, and in compliance with Articles 11 and 16 of the LSSI-CE, the Provider is at the disposal of all users, authorities and security forces, actively collaborating in the withdrawal or, where appropriate, blocking of all content that may affect or contravene national or international legislation, third-party rights or morality and public order. If the user considers that there is any content on the website that could be subject to this classification, please notify the website administrator immediately.

This website has been reviewed and tested to function properly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. However, the Provider does not rule out the possibility of programming errors, or that force majeure, natural disasters, strikes, or similar circumstances may occur that make access to the website impossible.

Intellectual and Industrial Property

The website—including but not limited to programming, editing, compilation and other elements necessary for its operation, designs, logos, text and/or graphics—is the property of the Provider, or where applicable has a license or express authorization from the authors. All contents of the website are duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registers.

Regardless of purpose, total or partial reproduction, use, exploitation, distribution and commercialization requires in all cases prior written authorization from the Provider. Any unauthorized use will be considered a serious breach of the author’s intellectual or industrial property rights.

Designs, logos, text and/or graphics not belonging to the Provider and which may appear on the website belong to their respective owners, who are responsible for any possible dispute that may arise regarding them. In any case, the Provider has express and prior authorization from them.

The Provider expressly DOES NOT AUTHORIZE third parties to redirect directly to specific content on the website; they must in all cases redirect to the Provider’s main website.

The Provider recognizes the corresponding industrial and intellectual property rights in favor of their owners; their mere mention or appearance on the website does not imply the existence of rights or any responsibility of the Provider over them, nor endorsement, sponsorship or recommendation.

To make any observation regarding possible breaches of intellectual or industrial property rights, as well as any content on the website, you may do so via the email address indicated above.

Accuracy of Information

All information provided by the user must be truthful. For these purposes, the user guarantees the authenticity of the data communicated through forms for subscription to services. It is the user’s responsibility to keep all information provided to TEAM GRAN VIA S.L permanently updated so that it responds, at all times, to their real situation. In any case, the user will be solely responsible for false or inaccurate statements made and for any damages caused to the Provider or third parties.

Minors

For the use of the services, minors must always obtain prior consent from parents, guardians or legal representatives, who are ultimately responsible for all acts performed by minors in their care. Responsibility for determining specific content accessed by minors lies with those adults; therefore, if minors access inappropriate content online, mechanisms should be established on their computers—in particular software, filters and blocks—that allow limiting accessible content. Although not infallible, these are particularly useful for controlling and restricting materials minors can access.

Obligation to Make Proper Use of the Website

The user undertakes to use the website in accordance with the law and this Legal Notice, as well as morality and good customs. The user shall refrain from using the page for illicit or prohibited purposes, harmful to the rights and interests of third parties, or in any way that may damage, disable, overload, deteriorate or impede the normal use of computer equipment or documents, files and all kinds of content stored on any of the Provider’s computer equipment.

In particular, and by way of example but not limitation, the user agrees not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound or image files, photographs, recordings, software and, in general, any kind of material that: (a) is contrary or undermines fundamental rights and public freedoms recognized constitutionally or in international treaties; (b) induces, incites or promotes criminal, denigrating, defamatory or violent actions; (c) induces, incites or promotes discriminatory actions, attitudes or thoughts based on sex, race, religion, beliefs, age or condition; (d) is contrary to the right to honor, personal or family privacy or the image of persons; (e) in any way damages the credibility of the Provider or third parties; (f) constitutes illicit, deceptive or unfair advertising.

Applicable Law and Jurisdiction

For the resolution of all disputes or questions related to this website or the activities carried out on it, Spanish legislation shall apply, to which the parties expressly submit, and the Courts and Tribunals of Madrid shall be competent for the resolution of all conflicts arising from or related to its use.
